The Pacific Railway Act of 1862 was enacted to construct a railroad connecting San Francisco to Omaha. Contracts were given to the Central Pacific and Union Pacific Railroad to link up in Utah. Land grants were attached to the contract as follows: 20 acre parcels would be awarded, as desired, in all odd numbered sections ten miles from either side of the track. In 1863 the ten limit was increased to 20 miles on either side of the track. The only condition for the granted parcel was that it was not to be in an area of known mineralization when the line was finally linked, which was in… 1869.
The phrase “mineral lands excluded” clearly written into the law. In 1864 the term” minerals” was defined as “hard metals”.
The General Land Office (predecessor the of BLM) administered the granted parcels through an “honor system”. The railroad land agent submitted the desired parcels and with a sworn declaration that the requested land was consistent with the Pacific Railway Act of 1862 and 1864. Patents were then issued.
